- Abstract:
On 29 Aug 2024, the Korean Constitutional Court ruled that the Carbon Neutrality Act violated the fundamental rights of the youth plaintiffs by shifting excessive burden of GHG reduction to the future generation. This marks the first judicial victory related to climate change in Korea, and South Korea became the first jurisdiction outside EU to acknowledge the violation of state's duty to set proper GHG reduction target. The presentation will focus on the key issues of the case, legal implications, and most importantly why courts around the world have stepped up on the issue of climate change and how it is justified under the separation of powers principle.
